| Resumo: | O presente trabalho analisa a persistência do Estado de Coisas Inconstitucional (ECI) no sistema prisional brasileiro após o julgamento da Arguição de Descumprimento de Preceito Fundamental (ADPF) n.º 347 pelo Supremo Tribunal Federal (STF). Parte-se da constatação de que, embora a decisão tenha representado importante marco na tutela estrutural dos direitos fundamentais das pessoas privadas de liberdade, as graves violações que motivaram seu reconhecimento permanecem presentes no sistema carcerário brasileiro. A pesquisa tem como objetivo compreender os fatores que explicam essa permanência, investigando os limites das respostas institucionais produzidas pela jurisdição constitucional. Para tanto, adotou-se abordagem qualitativa, desenvolvida por meio de pesquisa bibliográfica e documental, utilizando a ADPF 347 como estudo de caso jurídico. Inicialmente, examina-se a construção histórica do poder punitivo e a formação do sistema prisional brasileiro. Em seguida, analisa-se a origem da teoria do Estado de Coisas Inconstitucional, sua incorporação ao constitucionalismo brasileiro e as principais medidas estruturais determinadas pelo STF na ADPF 347. Por fim, a pesquisa interpreta a persistência do Estado de Coisas Inconstitucional à luz da teoria do poder desenvolvida por Michel Foucault, em diálogo com as contribuições de Marcelo Neves, Rodrigo Fuziger e Vera Malaguti Batista. Conclui-se que a permanência das violações estruturais no sistema prisional brasileiro não decorre da irrelevância da decisão judicial, mas da existência de relações de poder, racionalidades punitivas e práticas institucionais historicamente consolidadas que limitam a efetiva concretização dos direitos fundamentais das pessoas privadas de liberdade. |
| Resumo: | This study analyzes the persistence of the Unconstitutional State of Affairs (USA) in the Brazilian prison system following the judgment of Claim of Noncompliance with a Fundamental Precept (ADPF) No. 347 by the Federal Supreme Court (STF). It is based on the premise that, although the decision represented an important milestone in the structural protection of the fundamental rights of persons deprived of liberty, the serious violations that justified its recognition continue to persist within the Brazilian prison system. The study aims to understand the factors that explain this persistence by investigating the limits of the institutional responses produced through constitutional adjudication. To this end, a qualitative approach was adopted, based on bibliographical and documentary research, using ADPF No. 347 as a legal case study. Initially, the historical development of punitive power and the formation of the Brazilian prison system are examined. Next, the study analyzes the origins of the Unconstitutional State of Affairs doctrine, its incorporation into Brazilian constitutional law, and the main structural measures ordered by the STF in ADPF No. 347. Finally, the persistence of the Unconstitutional State of Affairs is interpreted in light of Michel Foucault's theory of power, in dialogue with the contributions of Marcelo Neves, Rodrigo Fuziger, and Vera Malaguti Batista. It is concluded that the persistence of structural violations within the Brazilian prison system does not result from the irrelevance of the judicial decision itself, but rather from historically entrenched power relations, punitive rationalities, and institutional practices that limit the effective realization of the fundamental rights of persons deprived of liberty. |
