Efeitos jurídicos da Lei nº 13.491/17 na investigação e julgamento de crimes militares no Maranhão

Abstract

The present work has the objective of analyzing the main legal effects of Law 13.49 / 17, which considerably altered the Military Penal Code, bringing a new concept of military crime. In the context of the PMMA, the competencies of the military judicial police have been enlarged, as well as new steps and measures for investigation become possible in the course of the investigation of military crimes. In this way, the Military Justice Audit of Maranhão also needed to adapt to the new legislation that brought to its jurisdiction, crimes that were previously within the jurisdiction of the Common Justice. In this way the research is about a recent issue of great importance when dealing with complex issues such as conflicts with the Special Criminal Law, in the case of the Maria da Penha Law and the Special Courts, on its applicability in military crimes. In order to contribute to the development of the analysis of the legal effects of Law No. 13.491 / 17, field investigations were carried out in the Military Justice Audit and in the Military Justice Prosecutor's Office in order to know the position of these bodies with regard to the legal effects caused in the trial and investigation by the military judicial police of those crimes that were once considered common
