Reflexos da vigência da lei ordinária n° 13.491/17 na atividade de polícia judiciária do Corpo de Bombeiros Militar do Maranhão

Abstract

The present work has as a general theme the effects of the Ordinary Law No. 13.491/17 in the activity of the Judiciary Police of the Military Fire Department of Maranhão. In this sense, the legal diploma, which modified article 9 of the Military Penal Code, by extending, in its item II, criminal types also provided for in the common and special penal legislation, reveals the following concern: what was the impact produced by the Law Ordinary No. 13.491/17 on criminal investigation activities conducted by officers of the Military Fire Department of Maranhão? To answer this question, a bibliographic analysis was carried out, seeking to understand the doctrine on the subject, as well as documentary research, since investigation and investigation procedures were quantified by object of investigation in the period from January 1, 2020 to May 26, 2021, when there was an increase of 33.3%, referring to criminal types included by Law No. 13.491/17, and also an increase of 16% of investigations investigating crimes typified in extravagant legislation. Furthermore, questionnaires were used in order to assimilate how the legal diploma has changed the perspective of the officers of the Military Fire Department of Maranhão in relation to the establishment and conduct of investigative procedures in the corporation. In this context, the questionnaires allowed us to identify as one of the main results that, despite the increase in the number of procedures in the period covered by the research, it was found that the majority of officers, 61%, are unaware of the content of the Law, also revealing legal training as important tool for the evolution of criminal investigation activities in the corporation
