Resumo: Este trabalho apresenta um estudo crítico sobre o conflito entre a prática de Fake News e a garantia de direitos fundamentais no ordenamento jurídico brasileiro. Investiga-se como a disseminação deliberada de desinformação em redes de alta interação deturpa o conceito de verdade e viola a dignidade da pessoa humana, afetando diretamente direitos fundamentais consagrados pela Constituição Federal de 1988, tais como o direito à informação, a liberdade de expressão, a honra e a imagem. O estudo demonstra que as fake news atuam na desconstrução da informação para atender a interesses privados, de poder e visibilidade, criando um cenário de insegurança jurídica. Metodologicamente, a pesquisa foi desenvolvida por meio do método dedutivo, com uma abordagem qualitativa, utilizando-se o procedimento bibliográfico e documental, com base na análise da doutrina penal e constitucional, de legislações vigentes, além das recentes decisões e resoluções do Supremo Tribunal Federal (STF) e do Tribunal Superior Eleitoral (TSE). Conclui-se que há uma necessidade premente de uma norma específica que possibilite a penalização eficaz dessa conduta, superando o atual vácuo legislativo e fortalecendo o Estado Democrático de Direito.
Resumo: This work presents a critical study on the conflict between the practice of fake news and the guarantee of fundamental rights in the Brazilian legal system. It investigates how the deliberate dissemination of disinformation on highly interactive networks distorts the concept of truth and violates human dignity, directly affecting fundamental rights enshrined in the 1988 Federal Constitution, such as the right to information, freedom of expression, honor, and image. The study demonstrates that fake news acts to deconstruct information to serve private interests, power, and visibility, creating a scenario of legal uncertainty. Methodologically, the research was developed using the deductive method, with a qualitative approach, employing bibliographic and documentary procedures, based on the analysis of penal and constitutional doctrine, current legislation, and recent decisions and resolutions of the Supreme Federal Court (STF) and the Superior Electoral Court (TSE). It is concluded that there is a pressing need for a specific law that allows for the effective penalization of this conduct, overcoming the current legislative vacuum and strengthening the democratic rule of law.
